The National Association of Officials of the Human Rights Subsecretariat (Anfuddhh) publicly condemned that the head of the office, lawyer Pablo Mira Hurtado, instructed not to appeal the ruling that released former DINA agent César Manríquez Bravo from prison.
This week, the San Miguel Court of Appeals granted a writ of amparo and ordered the release of the torturer, arguing that at 95 years old, he suffers from a condition equivalent to «supervening mental alienation.»
In this context, Anfuddhh reminded that «the institutional mandate of the Human Rights Subsecretariat is inspired by the guarantee of Truth, Justice, Reparations, Memory, and Non-Repetition,» which is realized through «the exercise of all necessary judicial actions within the framework of legal assistance to the families of victims of human rights violations that occurred during the military dictatorship in Chile.»
They further indicated that «the Human Rights Program, which provides legal and social support to the families of victims of political execution and forced disappearance, has historically been part of such decisions, seeking that perpetrators of crimes against humanity serve their sentences after years of impunity.»
«This competence was acknowledged by the Supreme Court in case Rol N°67.444-2016, as it relates to the enforcement of sentences imposed by courts in these processes,» added the officials of the Human Rights Subsecretariat.
However, despite the aforementioned, they denounced that «the authority of the Human Rights Subsecretariat, deviating from this precedent, instructed not to appeal the decision, which goes against the obligations of the State and the legal mandate of the institution itself.»
«Not exhausting all judicial instances in cases related to those convicted of human rights violations contravenes international law standards in this area, facilitating impunity and hindering the guarantee that such acts will not happen again,» Anfuddhh stated.
«This sets a poor precedent for other legal cases wherein the Human Rights Program, through its officials, is mandated to act,» the statement concluded, rejecting «political intervention» in this matter.
«We hope that the authorities fulfill their legal mandate to guarantee truth, justice, reparations, memory, and non-repetition,» said the Association.
