The parliamentary group of the Communist Party and Independents expressed their «deep concern and dismay» regarding the acquittal of former police officer Claudio Crespo, despite clear evidence that he was responsible for shooting and blinding current parliamentarian Gustavo Gatica.

«It is judicially established that our colleague has completely lost his sight due to pellet shots fired by Carabineros officer Claudio Crespo amidst the repression against social protests in November 2019,» the lawmakers stated in a public declaration.

They added, «Despite the irreparable severity of the damage, the ruling concludes that the accused has no criminal liability, relying on the notion of legitimate defense and the application of the Naín-Retamal Law,» describing this latter point as «especially serious.»

From the PC-Ind bloc, they criticized, «This ruling highlights not only a questionable judicial decision but also a form of normative impunity: gravely significant acts, established by the judiciary, remain unpunished due to legislation that broadens and presumes legitimate defense in favor of state agents.»

They emphasized that the ruling «affects the entire society, as it weakens trust in the rule of law, sends a message of neglect to victims of human rights violations, revictimizes individuals, and sets a profoundly dangerous precedent for Chile.»
