CDE Expands Lawsuit Against Former Minister Vivanco in ‘Fundamenta’ Case

The Council of State Defense (CDE) announced an expansion of the lawsuit originally filed in November 2025, now focusing on the «Fundamenta» aspect of the so-called «Audio Case.»

This legal action targets former Supreme Court Minister, Ángela Vivanco, for charges of bribery and misconduct; her partner, Víctor Gonzalo Migueles, for bribery and money laundering; and lawyers Carlos Eduardo Lagos, Mario Andrés Vargas, and Gabriel Moisés Silber, who are accused of participation in bribery and money laundering offenses.

According to the expanded filing submitted to the 7th Guarantee Court of Santiago, within the context of the environmental conflict between the developer Fundamenta and local residents of Ñuñoa, triggered by the ‘Egaña-Comunidad Sustentable’ (Eco Egaña) project, the company hired the legal firm Lagos, Vargas & Silber for significant amounts to «resolve this issue and seek a solution.»

The document further states that the lawyers, «without officially representing the client, engaged in certain illicit activities to obtain favorable judicial resolutions.»

In this context, the CDE claims that attorneys Eduardo Lagos, Mario Vargas, and Gabriel Silber allegedly made illegal payments to former judge Ángela Vivanco through Víctor Gonzalo Migueles. The aim was for Vivanco, while presiding over the Third Chamber of the Supreme Court, to take actions and issue rulings that directly benefited Fundamenta.

«The CDE emphasizes that former minister Vivanco severely breached her duty of impartiality by failing to disqualify herself, despite having close personal and financial ties with the legal team of the developer,» the agency stated in a press release.

Lastly, the lawsuit alleges that the payments were disguised through financial maneuvers and fund triangulations, thus constituting the crime of money laundering.
