Legal Action Initiated Over Significant Losses in Pension Fund Administrators: «Financial Compensation and Audit Required»

The Coordinadora NO+AFP has proposed a shift from «digital indignation to a rigorous legal and financial strategy» in response to the substantial losses recently reported by pension fund administrators.

In a statement, the organization condemned the pension fund industry’s attempts to normalize this calamity as a mere «market fluctuation» or «long-term investment.» Historical data reveals reckless engagement with derivatives and interest rate swaps, transforming the system’s most conservative fund into a high-risk environment for current and future retirees.

The Coordinadora highlighted that pension fund administrators have strict legal obligations regarding security, profitability, and risk management, asserting that «when these are violated, public trust erodes. We will not accept this harm being treated as an anonymous market incident: there are managers, regulators, and decisions with names that must answer in court.»

Consequently, they have called upon affected affiliates, lawyers, economists, actuaries, and accountants to form an interdisciplinary task force focusing on three immediate actions: Financial audit and civil suit against pension funds; secondary suit against the government; and demanding that the State Defense Council takes on the defense of those affected, along with a public challenge and review of the 2025 pension reform.

The organization reported that they are already engaged in two simultaneous initiatives: “Voluntary Registration of Affected Parties,” encouraging contributors and retirees who remained in the Fund E and Fund C during the 2025-2026 period to gather their historical statements and account balances. The goal is to build a broad base for accurately calculating damages, they explained.

The second task involves establishing a Technical Interdisciplinary Front, inviting “professionals from finance, accounting, and law to join in analyzing swap contracts, assessing applied investment policies, and drafting lawsuits.” Read the complete statement below:
