Through a public statement, the deputies and deputies of the Communist Party of Chile expressed their «full solidarity» with their colleague, Gustavo Gatica (Ind.), and his family, following the ruling from the Court of Appeals that denied the nullification request in the case of ex-Carabinero Claudio Crespo, who was found to have shot and blinded Gatica.
«Respect for the decisions of the Judiciary is a fundamental principle of any democracy founded on the separation of powers. Nonetheless, we express our disagreement with this resolution,» said the parliamentarians.
«Therefore, first, we reject that this ruling be used to create a narrative that does not align with its content. The sentence established that Claudio Crespo fired the shot that blinded Gustavo Gatica. The acquittal, based on the application of the Naín-Retamal Law, does not erase those facts, as there is a legal truth regarding them,» the statement adds.
Moreover, the PC bloc emphasized that this ruling «sets a concerning precedent for Chile regarding justice and truth. In this sense, we find the statements of the President of the Republic to be partial and reckless, as they aim to establish a climate of impunity regarding human rights.»
«We demand that President Kast act with the responsibility expected from a head of state,» expressed the PC legislators.
As reported by El Ciudadano, the Court of Appeals of Santiago unanimously confirmed the acquittal of ex-Carabinero Claudio Crespo, despite evidence showing that his shots caused Gustavo Gatica’s blindness during the social unrest of 2019.
With this decision, the ruling issued by the Fourth Oral Criminal Court of Santiago in January remains firm after the request for nullification seeking to annul the trial and order a new one was denied.
