The INDH has filed a lawsuit for unjust treatment following the death of a police lieutenant at the Pailahueque Police Station. The victim, who was an accused in an internal investigation, died from a gunshot wound to the head while under state custody, allegedly without being guaranteed his basic procedural rights.

La víctima, imputado en una investigación interna, falleció por un disparo en la cabeza mientras estaba bajo custodia estatal, sin que se le garantizaran sus derechos procesales básicos, según se denunció.

The Appeals Court of Temuco determined that "there was no documentation of any hypothetical flagrance, nor was it verified that the petitioners engaged in any conduct that justified the use of coercive immobilization techniques, let alone warrant the application of potentially harmful force, such as cervical compression or repeated exposure to irritants."

La Corte de Apelaciones de Temuco determinó que “no se consignó la existencia de ninguna hipótesis de flagrancia, ni se verificó que los amparados hubiesen realizado conducta alguna que justificara el empleo de técnicas coercitivas de inmovilización, ni mucho menos que legitimara la aplicación de fuerza potencialmente lesiva, como compresión cervical o reiterada exposición a sustancias irritantes”.
