El fallo se fundamenta en el relato que el propio denunciante presentó ante la Comisión Valech y en los antecedentes judiciales. La resolución escribe dos episodios de secuestro y tormento ocurridos en marzo de 1988, cuando el joven vivía con su familia en la comuna de Pedro Aguirre Cerda.

"My torturers and assailants were from the Naval Intelligence Service (SIN)," denounced the teacher, who according to her account was subjected to all kinds of abuses and humiliations—including physical and sexual assaults, beatings, and electric torture.

At the time of the incidents, the victim was a 25-year-old pedagogy student at the Universidad Austral de Chile and a mother of two children aged 2 and 3.

The Twenty-Fifth Civil Court of Santiago grounded its decision in "the age of the claimant and her family context, the temporal extent of her father's detention, and the unlawful duress and torture he suffered, as well as the sequelae resulting from them, particularly concerning the mental health of the claimant and the implications for her family life."

El Vigesimoquinto Juzgado Civil de Santiago fundamentó su decisión en "la edad de la demandante y su entorno familiar, la extensión temporal de la detención de su padre y los apremios ilegítimos y torturas de que fue víctima, así como las secuelas provocadas a raíz de ellos, en particular, en lo referente a la salud mental de la actora y las repercusiones en su ámbito familiar".

According to the ruling, the victim was 23 years old, a student, and a community leader in Las Condes, affiliated with the Christian Left. He was detained and tortured by Carabineros in 1985 and 1988 during Augusto Pinochet's dictatorship, subjected to kicks, punches, and buttstock blows.
